PRIVACY POLICY PURSUANT TO ARTICLE 13 EUROPEAN REGULATION 679/2016 – CANDIDATES
The “Data Controller”
Pursuant to Article 13 of EU Regulation 679/2016, Fantini Cosmi S.p.A., with registered office in Via Dell’Osio No. 6, Caleppio di Settala (MI) Italy, tax code and VAT No. 12294350157, informs you that it is the Data Controller, pursuant to Article 24 of EU Regulation 679/2016 of the processing of your personal data. The Data Controller informs you that the personal data acquired, also with reference to existing legal relations, are subject to processing in compliance with the legislation mentioned above. In connection with the processing operations mentioned above, the Data Controller provides, inter alia, the following information.
Personal data refers to any information relating to an identified or identifiable natural person; an identifiable person is any natural person who can be identified, directly or indirectly, through an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to his or her physical, physiological, genetic, mental, economic, cultural or social identity.
“Processing”, (pursuant to Article 4 Regulation 679/2016), means any operation or set of operations, carried out even without the use of electronic instruments, involving the collection, recording, organisation, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, dissemination, erasure and destruction of data, even if not registered in a database.
Such processing must be carried out pursuant to Article 1 of Legislative Decree 196/2003 as amended by Legislative Decree 101/2018 and based on the principles of fairness, lawfulness, transparency, protecting your confidentiality and your rights.
Personal data collected
The personal data collected basically relate to:
– identification data (name and surname, address, telephone, e-mail);
– LinkedIn profile, job position information; education and professional and work-related information;
– any additional data included in the Curriculum Vitae or provided during the interview.
Processing purpose
This data processing is exclusively for the purpose of recruiting personnel to be employed within our company.
Nature of data provision and legal basis for processing
The provision of data and the processing of the data are mandatory for the Data Controller to perform all activities necessary and essential to the personnel recruitment/verification of the possibility of establishing an employment relationship. Legal basis: performance of a contract to which the data subject is party or performance of pre-contractual measures taken at the request of the data subject; need for the Data Controller or the Data Subject to fulfil obligations and exercise specific rights in the field of labour and social security law and social protection in the case of protected categories.
Any refusal to provide data for these purposes will make it impossible for the Data Controller to carry out the recruitment process.
Processing methods
Personal data will be processed in hard copy, computerised and telematic form and entered in the relevant databases, which may be accessed and thus come to the knowledge of employees expressly designated by the Data Controller as authorised/designated for the processing of personal data, who may consult, use, process, compare and carry out any other appropriate operation, including automated operations, in compliance with the provisions of the law necessary to guarantee, among other things, the confidentiality and security of the data as well as their accuracy, updating and relevance to the stated purposes.
Duration of the processing
The data will be processed for as long as necessary to carry out the recruitment process and for 6 months after the date of acquisition of the data.
Scope of data disclosure and dissemination
In order to be able to fulfil the activities and purposes described above and in relation to the management and business model adopted, the data may be disclosed to the categories of subjects listed below, duly authorised to process the data, in their capacity as autonomous data controllers or data processors:
– Employment agencies/staff recruitment companies;
– professional firms;
– competent authorities and/or Supervisory Bodies for the fulfilment of legal obligations;
– public administrations for their institutional purposes;
– qualified professionals for the study and resolution of any legal and contractual problems.
The list of External Data Processors with further useful identification data can be requested from the Data Controller at the addresses given in this privacy policy.
Data may be disclosed for processing purposes to entities not belonging to the company, exclusively for the above-mentioned purposes.
The dissemination of personal data is not envisaged.
The transmission of data to third or non-EU countries is not envisaged.
Rights of data subjects
In relation to the above mentioned processing operations, you may exercise your rights under Chapter III of EU Regulation 679/2016 Articles 15 – 22, which include:
– obtain confirmation of the existence or otherwise of your data;
– know the origin of the data, the logic and purpose on which the processing is based;
– obtain access, cancellation, transformation into anonymous form or blocking of data processed in violation of the Law, updating, restriction, rectification, revocation, portability and integration of the data;
– oppose, for legitimate reasons, the processing of the data;
– lodge a complaint with a supervisory authority pursuant to Article 77 of EU Regulation 679/2016 (http://www.garanteprivacy.it/web/guest/home/docweb/-/docweb-display/docweb/4535524),
